Understanding Probate
Probate is required to protect the assets of the deceased person and to ensure that those assets pass only to the persons who are legally entitled to inherit them.
Whether the deceased left a Will or not, if Probate is required or is requested by a financial institution it must be applied for through the Probate Court.
It is the responsibility of the ‘Executors’ named in a Will or the ‘Administrators’ when there is no Will, to conduct the administration of the deceased’s estate which includes obtaining a Grant of Probate or Letters of Administration.
How do I get a Grant of Probate?
If you do need to obtain Probate you must assess the size of the estate and establish the legal complexities involved. Once you have diagnosed the type of Probate application required you must then assess and value the estate and fill out the relevant forms to both the Probate Court and the HMRC. Once the forms have been completed you will need to book an appointment at the Probate Court to attend an interview along with the submitted application.
Once Probate has been obtained you must ensure that any outstanding debts are settled before you look to pay the net proceeds of the estate to the beneficiaries.
Establishing the beneficiaries must be done by the wishes left in a Will or by applying the laws of intestacy where there is no Will.

How much does this service cost?
There is a fixed fee for our service of £589* which is inclusive of VAT.
Many probate solicitors in London charge an hourly rate and some also charge a further percentage based on the value of the estate. Hourly rates leave executors or administrators unsure how much they will be paying at the end of the process.
